Assault
In Texas, assault is primarily defined under Section 22.01 of the Texas Penal Code. Assault can occur in various forms, each encompassing different actions and intentions. Generally, assault involves intentionally, knowingly, or recklessly causing bodily injury to another person, threatening another with imminent bodily injury, or causing physical contact with another when the perpetrator knows or should reasonably believe that the other person will regard the contact as offensive or provocative. The first form, causing bodily injury, necessitates an actual physical harm inflicted upon the victim. This harm does not have to be severe but must be more than mere touching. The second form, threatening with imminent bodily injury, does not require physical contact. Instead, it focuses on the perceived threat of harm, which must be immediate and credible. The third form, causing offensive or provocative physical contact, emphasizes the nature of the contact and the perception of the victim, rather than the intent of the perpetrator.Battery

Traditionally, battery refers to the unlawful and intentional touching or striking of another person against their will, resulting in physical harm or offensive contact. In Texas, actions that would constitute battery in other jurisdictions are prosecuted under the assault statutes. Therefore, what is commonly referred to as battery in other states is addressed as a form of assault in Texas. This includes the intentional infliction of bodily injury or the offensive or provocative physical contact mentioned earlier. The distinction between assault and battery, while legally significant in some jurisdictions, is effectively merged under Texas law. However, understanding the traditional concept of battery is still useful for comprehending the full scope of actions that Texas law categorizes as assault.
