If you have been arrested or convicted of driving while intoxicated (“DWI”), you may have been ordered to use an interlock system (“interlock”) or a Secure Continuous Remote Alcohol Monitor (“SCRAM”) as part of your sentencing. Below are some examples under Texas law when a DWI conviction may require the installation of an interlock or SCRAM as a condition of bail, intervention programs, and probation.
Interlock and SCRAM Conditions in Texas
What is an Interlock or SCRAM?
An interlock device is a portable breathalyzer that is attached to your automobile under the dashboard. At one end of the device is a blow tube and at the other end of the device is a cord that runs underneath the vehicle’s dash. The breathalyzer is installed into the ignition system of the vehicle and must be used in order for the car to start. The vehicle will not turn on unless a breath sample is provided and that sample is calibrated at the specific time and locations. The device may require you to provide additional breath samples every five to 30 minutes to keep the car running. Many devices now have cameras attached to them to ensure you are the person blowing into the tube.
A SCRAM, on the other hand, is an ankle bracelet that communicates to a monitoring station through a modem. The device tests for the presence of alcohol every hour and does so through the person’s perspiration. The SCRAM includes a sensor designed to report if anyone has tampered with the device. The system will also test as much as every 30 minutes if alcohol is detected.
