Understanding the Legal Definition of DWI in Texas
In Texas, a person is considered to be driving while intoxicated if they are operating a motor vehicle in a public place while under the influence of alcohol or drugs. Intoxication is legally defined as not having the normal use of mental or physical faculties due to the consumption of alcohol, drugs, or a combination of the two. Another way intoxication is measured is through a person’s blood alcohol concentration, also known as BAC. For most drivers, the legal limit for BAC is 0.08%. If a person’s BAC meets or exceeds this limit, they can be charged with a DWI, even if they feel like they are still able to drive safely. There are also stricter rules for certain drivers. For example, if a driver is operating a commercial vehicle, the legal limit for BAC is lower, set at 0.04%. This is because commercial drivers are held to higher safety standards. Additionally, if the driver is under the legal drinking age of 21, Texas has a zero-tolerance policy, meaning any detectable amount of alcohol in their system can result in a DWI charge.How Law Enforcement Determines Intoxication
When a law enforcement officer suspects that a person is driving while intoxicated, they will pull the driver over and begin an investigation. After stopping the vehicle, the officer may ask the driver if they have consumed any alcohol or drugs. Based on their observations, the officer may ask the driver to perform a series of field sobriety tests. These tests are designed to check a person’s balance, coordination, and ability to follow instructions. Some common tests include walking in a straight line, standing on one leg, or following a moving object with their eyes.
